General information regarding personal data processing in MJH

MJH Moskwa, Jarmul, Haładyj i Partnerzy - Adwokaci i Radcowie Prawni spółka partnerska is a personal data controler regarding the data obtained within the scope of its bussines activity. MJH processes personal data:

  1. in order to inform about business activity of MJH and to verify the effectivness of such information in particular via maintaining a web page and a LinkedIn profile, based on a legitimate interests of MJH in increasing market awareness of MJH services and evaluation of activities carried out in this field;
  2. to establish and maintain business contacts by collecting information about the persons with whom persons representing MJH contact and exchange information, on the basis of MJH legitimate interest in raising market awareness of MJH services and obtaining information to offer legal services;
  3. for the purpose of providing legal services, in particular for the purpose of concluding and performing a contract for legal services, on the basis of a contract for the provision of services, where the data subject is a party to such contract and on the basis of MJH legitimate interest in maintaining and developing its business, if the contract party is not a natural person;
  4. for the purpose of concluding and performing other contracts to which MJH is a party, on the basis of MJH legitimate interest in ensuring that MJH is able to conduct a business;
  5. in order to carry out recruitment, on the basis of activities aiming into concluding a contract, where recruitment concerns the conclusion of a civil law contract and on the basis of the law and consent of the person, where the recruitment concerns the establishment of an employment relationship, and in both cases MJH also processes the personal data of candidates on the basis of a legitimate interest of MJH in assessing the candidate's qualifications and establishing possible terms of cooperation;
  6. to document the acquisition of rights or property, on the basis of MJH legitimate interest in defending and exercising the rights and rights of MJH;
  7. to establish or pursue possible claims or to defend against claims against MJH, on the basis of MJH legitimate interest in maintaining its business, ensuring that rights can be exercised and protecting MJH reputation;
  8. to comply with legal obligations, under applicable law, in particular those governing the obligations and conduct of attorneys-at-law and advocates and MJH as an employer, principal, employee seeking entity, taxpayer, social security contributor and entrepreneur.


Please note that the MJH website uses few cookies. These are:

  1. one session cookie used only for a given web browser session and deleted after it is closed – necessary for the operation of the website;
  2. two persistent Google Analytics cookies , which expire after 24 hours and expire two years after using the MJH website, in order to identify unique users of the website and their behavior on the MJH website;
  3. one persistent long-term cookie – stores information regarding the fact that you accept the privacy notice of the website. The personal data processed by MJH may be shared with MJH service providers, in particular accounting entities, entities providing IT support, providing services regarding operation and maintenance of servers or licensed IT systems, providing public relations services, postal operators, couriers or recruitment agencies.

MJH processes personal data to the extent and for a period justified for the purpose of processing. The purpose of the data processing also determines the period of storage of personal data. For example, personal data processed for the purpose of concluding and executing a contract are processed and stored for the duration of the contract and after its expiry, for the period and to the extent necessary to document an economic event having tax implications and, where justified, for the period necessary to protect against or pursue claims relating to the contract. If, under the contract, MJH has acquired a right, for the period during which MJH is entitled to that right, which may mean that such data are stored perpetually or for a very long period (e.g. in the case of the acquisition of ownership of the property or the acquisition of copyright). Personal data processed by advocates and attorneys-at-law in the exercise of the profession is retained for 10 years from the end of the year in which the proceedings in which the personal data were collected ended.

Persons whose data is processed by MJH may have the following rights:

  1. the right of access to data;
  2. the right to rectification, erasure or restriction of processing;
  3. the right to object to the processing of data;
  4. the right to data portability;
  5. the right to withdraw consent to the processing of data, but this withdrawal does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal;
  6. the right to lodge a complaint with the supervisory authority.

 
Not in every case it is possible to exercise the rights mentioned above effectively. For example, the right to erasure cannot be exercised if the data are still needed to fulfil legal obligations or necessary for the establishment, exercise or defense of claims and the right of objection does not apply to personal data collected by a solicitor or lawyer in connection with the provision of legal aid.

The provision of personal data processed by MJH may be voluntary (as in the case of the provision of additional data by the candidate for work or the provision of information useful for the provision of legal services) or result from statutory requirements (as in the case of providing data necessary for the performance of tax obligations or obligations of the payer of social security contributions or data that the employer in accordance with the law requests from the candidate for work). Failure to provide data where this is necessary for the performance of its statutory or fundamental legitimate interests of MJH may prevent the performance of the task in question or the conclusion of a contract.

MJH does not take decisions by automated means, in particular it does not perform profiling of the persons whose data is being processed.
